Court Fight Over Guard Activation

In an urgent petition, the justice department asked the court to overturn a previous judicial decision that had halted the sending of several hundred military reserve members to the Chicago area.

The district judge had expressed skepticism about the administration's explanation for deploying forces, questioning its rationale in considering local conditions.

A federal appeals court supported the previous order on midweek, maintaining the stationing on pause while the legal challenge moves forward.

Administration's Arguments

The top government lawyer, acting for the administration, wrote in the recent request that federal agents have frequently been “threatened and assaulted” in Chicago and the neighboring town of Broadview community.

The commander-in-chief has already sent national guard forces to the Windy City and Portland, Oregon, subsequent to earlier sendings to Los Angeles, Memphis, Tennessee, and Washington, District of Columbia.

The administration has argued that armed forces involvement is required to curb unrest and support deportation efforts.

Illinois and municipal government together took legal action against the White House to halt the activation.
